The Public Prosecutor made an ultimatum to the McCanns: or the reenactment of Maddie's disappearance that will take place on the next 29th of May or the Public Prosecutor will advance with the accusation of gross negligence against the couple.

The PJ also informed the McCanns that "either all of them return (on the 29th) or none will come" as it was admitted by the spokesman of the couple, Clarence Mitchell to the 24 Horas. All, should be read Kate, Gerry and the seven friends that dinned with them in the Tapas, at Praia da Luz on the 3rd of May of 2007.
Clarence Mitchell admitted to the 24 Horas that the reenactment will not take place on the 29th due to doubts of the friends.
Kate and Gerry as the 24 Horas has already reported should be accused of gross negligence being the maximum penalty ten years jail.
"There has not been any kind of cooperation with the authorities from their part. What is strange for parents that are constantly and publicly claiming that they want to find their missing daughter. It is an unusual behaviour. Any father or mother that had lost a child would have all interest in cooperating with the authorities. The truth is from the McCann's part that help does not exist. What they say is that they are willing to come to Portugal but only under certain conditions", explained to the 24 Horas a source from the Portimão's Court.
According to the same source, after the suggestion of the Public Prosecutor to make the reconstruction on the 15th and 16th of May, a new date was suggested: the 29th of May. However less than a week from that day the Portuguese authorities are still empty handed. Neither the parents nor their friends gave any signal of life.

Enough evidence

"We have the conviction that the parents participated in the concealment of the body's girl and that she is dead. Although the existing evidences are not enough to accuse them of homicide. But we have more than enough evidence to accuse them of negligence. They know that and they don't return to Portugal probably because they are afraid of being arrested", said another judicial responsible connected to the investigation.
"It is not understandable the reason why they are all dragging their feet - including the McCanns - to participate in a reenactment that will probably last 6 hours".

Facts

If the Public Prosecutor goes ahead with the accusation of gross negligence against the McCanns, Kate and Gerry will claim that they were "responsible parents" in the night of the 3rd of May, explained Clarence Mitchell. That is the advise given by the Portuguese and British lawyers.

The reenactment of the facts occurred in the night of 3rd of May of 2007 will not be done on the 29th due to questions raised by the seven friends of the McCanns to the PJ. "We are in a phase that the friends, one by one, are presenting their arguments to the PJ. They do not understand the objective of the reenactment one year after the disappearance of Maddie". The friends also "emphasise that more people should participate in the reenactment such as the employees of the Ocean Club and other witnesses". But Kate and Gerry due to the fact that they are arguidos, will come to Portugal if the PJ demands.
Caught by surprise with the fact that the Public Prosecutor might advance with the accusation of gross negligence against the McCanns, Clarence questions: "Why that accusation now, one year after the facts? It seems strange".

Below is a detailed account of what Gerry McCann claims are the last times he saw his daughter alive. There are several statements that have been leaked today from their "appearance" in Brussels that are very disturbing. I think the most disturbing is Gerry's continued insertion of an alibi into almost every time line that has been given. He gives excuses for where he was, what he thought, and things he said that sound so sugary sweet and lovely. It's my belief that his wife hit Madeleine that night, while he was at Tennis; and she fell dead. When Gerry returned, he devised this plan to hide what had occurred calling it a "disaster" to his closest family members on the phone.
I don't think most of us would say that a "disaster" happened. Unless of course you came back from a tennis lesson to find your unstable wife had killed your first child.
In order to save face, careers and futures, the Wider Agenda and "Scheme" was cooked up to cover their asses. I firmly believe this; and I would need to see Madeleine Produced, for be to believe otherwise. A Good Law Enforcement Det. can always tell when something is UP with their Suspect. Monsters come in all shapes and sizes and murder and domestic violence knows NO party line, it does not discriminate. Ever. Do Not Judge A Book By It's Cover. Ever. Gerry McCann gave Portuguese police a detailed account of his movements in the hours running up to his daughter's disappearance.

After playing tennis in the afternoon of May 3, 2007, he returned to their holiday apartment.

According to the Spanish TV reports, Gerry told police: "When I arrived at the apartment I was surprised to see that Kate had taken care of the children and had even had a shower.

"I sat down with the children and I read them a bedtime story.

"At 7.15pm we put them to sleep.

"At 7.30pm we were sat in the living room and relaxing, Kate with a wine and me with a beer.

"We talked about what a nice week we'd had and what an ideal holiday it had been.

"Just before 8pm I went to shower and change.

"We had just a little time so I had another wine while I was watching TV then we went out."

The heart surgeon checked on his children around 9pm.

He added: "I saw the angle of their door had changed and it was open around 45 degrees.

"I thought perhaps Madeleine had woken up and left the room.

"Out of the corner of my eye I looked in our room and couldn't see her.

"Then I opened the children's door 60 degrees and looked to the left and saw Maddie sleeping with her head on the pillow on the right hand side of the bed.

"She was breathing softly and I thought how beautiful she looked.

"I thought it was quite hot and I didn't need to cover her up."

In his statement, he described the terrifying moment he learnt of Madeleine's disappearance just after 10pm.

He said: "Kate came running to the bar and said, 'Maddie's not there, someone has taken her,'"

"I couldn't believe it and ran towards the apartment along the same route I always took. I looked everywhere.

"I returned to the children's room and I tried to think what could have happened.

"To my surprise I realised I could lift up the window shutters without effort and almost without making noise.

"When I entered I realised that Maddie's bed was almost intact. The corner of the outside of the sheets was turned a little.

"But the pillow, her Cuddle Cat and the blanket she had slept with were almost in the same place as I had seen them the last time."

Mr McCann also told police that workmen had come into their holiday apartment to fix a broken window shutter in the main bedroom just two days before she disappeared.

Closest Thing To a Confession In His Own Words

“Sometimes people do things for reasons that even they cannot understand,” Mr McCann, a devout Catholic, wrote.

“An act of madness, an accident or sudden impulse can lead to consequences that people may never have imagined or intended.

“Faced with such a situation we believe any human soul will ultimately suffer torment and feelings of guilt and fear.”

On Gerry McCanns blog he has written the above statement. I happen to believe along with many others that this is the closest we will ever come to a "confession" in the death of little Madeleine McCann. In other words, Gerry McCann felt compelled to do or say something; after that May 3 "disaster" occurred, and that IS what he called it when Madeleine "went", a "disaster".

You have to ask yourself, after viewing all the photos in this case; all the video all the interviews and all the articles, especially the early ones, why do you believe that an abduction occurred if Law Enforcement does not? I'm with LE on this one; they knew 3 wks in; and maybe sooner that the McCanns time line and "stories" did NOT add up. There were no shutters "askew" there was no abduction there was no open window or locked doors.

There were just three little babies, two 18mos old and one 3 yr old, left all alone in a holiday flat to fend for themselves. Supposedly. The time line IS that this Mother, was the last person to see little Madeleine alive. That this "mother" wrote about issues she had with motherhood and how she was struggling in her marriage and motherhood; especially with little Madeleine and her "screaming". So it bodes to ask; how long will it take to build the case against the McCanns? At least there is no statute on Murder, and if they never see the inside of a cell; they will live in one for the rest of their lives, no matter where they go.

This is the woman who believes she was the last person to see Madeleine McCann alive.
Holidaymaker Jane Tanner claims to have seen a man carrying the missing British toddler in his arms away from the Portuguese resort where she disappeared in May.
She has spoken exclusively to a US television show that has investigated the tot’s whereabouts. The programme, 48 Hours Mystery, airs tomorrow / tonight (Sat Nov 17).
But in a preview shown in the States today (Fri Nov 16), she opens up about the sighting for the first time.
She said: “I never in a million years thought it could have been Madeleine.
“I just saw somebody walking across the top of the road, and that person was carrying a child.”
Madeleine, now four, went missing from her family’s holiday apartment in Praia da Luz, Portugal, on May 3 while her parents Gerry McCann and wife Kate, dined nearby at a tapas bar.
The woman - one of the so-called ‘tapas seven’ - says she saw the man carrying a child wearing pink pyjamas, the same colour as Madeleine’s.
Gerry McCann, from Rothley, Leicestershire, says in the programme:

“We will always live with the fact that Kate and I were not in the apartment when it happened and we have to face up to that.

“We’re very much trying to focus on what can be done now, not what could have been done before because we did not do it.”

The show will also feature never-before-seen video footage of the McCanns shot by a family pal over the course of a week. The intimate footage tracks the McCann family following their daughter’s disappearance from their rented apartment in the Algarve region of Portugal.
The video also shows the family canvassing local neighbourhoods in the rented car where police say they found Maddie’s DNA, subsequently causing them to name Gerry and Kate McCann as official suspects in the case.
48 Hours Mystery correspondent Peter Van Sant said: “It’s very touching, very moving material.
“And you’re going to hear facts that you’ve never heard on this case, including a conclusion by [undercover investigator] Joe as to what he believes really happened that night.”
He added: “This woman is extremely important to the investigation.
“She was one of the ‘tapas seven’ - that’s the seven friends who were at this bar at the resort.
“And she has come forward after six months to say she saw something that night.
“She believes that she saw a man carrying a child in his arms away from the resort.
“She saw the colour of the pyjamas down by the feet, which were pink, which were the colour of the pyjamas that Maddie was wearing that night.
“So for the McCanns this woman is extremely important.
“It’s a world exclusive.”

In addition to the new footage, the show also talks to John Ramsey, the father of murdered child beauty queen, Jon Benet Ramsey, as well as Ed Smart, the father of Elizabeth Smart, who disappeared and was found nine months later, in their first interviews about the McCann case.
Smart is expected to reveal a private conversation he had with Gerry McCann. It also features private investigator Joe [Joseph] Moura, a Portuguese speaker who went undercover for almost two weeks at the Praia da Luz resort. He told The CBS Early Show in New York today (fri): “I was looking for some answers in reference to the storylines that we have read and heard about.
“I felt that the people who worked there, the employees, would be the ones to tell us what the routines were, the timelines [were].
“I thought it would be critical to the investigation, that’s why we went there.”
“Everything you read in the press is nonsense, it’s trash.
“That’s why we went undercover.
“The employees did not want to speak to the media.
“They were fed up with the media. They were actually misleading the media with certain stories.
“With the story we went in with, we got to befriend some of these people and they told us what really went down, and specifically the routine of the ‘tapas seven’ and including the McCanns.”
Van Sand said that Moura’s ability to speak the language helped him uncover crucial new information.
Moura went on: “What’s really important in this is that the Portuguese police is not allowed to divulge any information.
“When we work a story in the States we are able to get police reports and timelines.

“We have to establish a timeline.

“By establishing that timeline we certainly could make a determination of what could have happened and what could not have happened.”

They actually wanted access to those funds once Both were named as the primary suspects in the death and disappearance of their child, Madeleine McCann.

TWO members of the party that dined with Kate and Gerry McCann on the night their daughter disappeared have told police they want to change their stories, it was sensationally claimed last night.
Lawyers acting for the pair allegedly contacted Portuguese detectives informing them their clients wanted to be re-interviewed in order to “correct” their original statements.
The McCanns’ official spokesman last night angrily dismissed the claims but sources close to the investigation said the pair had kept their decision secret in order to avoid pressure from anyone else in the group.
The startling claim comes just days after it emerged that four members of the so called Tapas Nine – who had dinner with Kate and Gerry on the evening of May 3 – were about to be declared official suspects by the Portuguese police. Detectives were understood to be concerned about alleged inconsistencies in statements given by the McCanns’ friends shortly after Madeleine went missing.
It was claimed Dr Russell O’Brien and his partner Jane Tanner, Matthew Oldfield and Dr David Payne were all expecting to be made arguidos in the coming days. The respected Spanish newspaper El Mundo suggested it was this which had led to two members of the group changing their stories.

The paper claimed: “Lawyers of two of the friends of the McCanns that dined with them on the night of May 3 in the tapas restaurant have contacted police recently and said their clients are willing to be re-questioned so they can ‘correct’ details of their original statements.
“These two members of the group have asked for their identities to be kept secret because they fear that as a result of the ‘clarifications’ they intend making about what happened the night Madeleine disappeared, they may be pressured by people linked to the McCanns.”
But the McCanns official spokesman Clarence Mitchell last night said the claim was “categorically untrue”. He said: “All the friends have consistently told the truth. They have no need to change their statements as they have nothing to hide. “They have always said right from the beginning that they were happy, more than happy, to be re-interviewed by the police. “The fact is they are keen to be re-interviewed to clarify any inconsistencies that the police have or may feel exist in their statements.
“To suggest they are changing their story is an utter misrepresentation of their willingness to help the police.” He added: “I have made enquiries of all the friends. It is categorically untrue that any letter has gone through on behalf of any of them.” And a friend of the McCann’s added: “Kate and Gerry are still friends with all those who were there that night. They frequently speak to each other and there has been no falling out.”

The Tapas Nine have faced a barrage of criticism in the six- months since Madeleine disappeared for refusing to speak about the events of that fateful evening. They were even accused of orchestrating a pact of silence in order to frustrate the police’s attempts to build a case against Kate and Gerry.
While it remains unclear what changes if any might be made to their previous statements any divergence from the original version of events would be bound to put pressure on the McCanns. The secrecy of justice laws which operate in Portugal mean anyone connected to an investigation is prevented from speaking publicly about the case.
This means very little is known of what actually happened in the hours immediately before and after Madeleine disappeared. It is believed the McCanns left their children asleep in apartment 5A of the Ocean Club, before heading down to dinner at the complex’s nearby tapas restaurant around 8pm.
They were then joined by their seven friends Dr Russell O’Brien and his partner Jane Tanner, Dr Matthew Oldfield and his wife Rachael, David Payne and his wife Fiona and her mother Dianne Webster. The group claimed they had been checking on their own children at half hour intervals but at 9.30pm Dr Oldfield offered to look in on Madeleine and the two-year-old twins Sean and Amelie.
It is thought he did not enter the McCanns’ apartment but hearing no noise at the door assumed everything was fine and returned to dinner. It was at 10pm when Kate checked on the children that she discovered Madeleine was missing and raised the alarm. Each member of the group has given the Portuguese police their version of events.
But sources within the Policia Judiciaria have said several of the statements are riddled with inconsistencies. Attention has been focused on Ms Tanner’s claims that she saw a man carrying a child wrapped in a blanket near the McCanns’ apartment around 9.15pm. Other independent witnesses in that area at the same time said they saw no one matching that description however.
Speaking from her home in Exeter, Devon last night Ms Tanner said: “I’m not going to make any comment. It is absolute rubbish. We’ve had no contact with the police. I won’t say anything else because it would be twisted.” Dr O’Brien’s statement was also said to be of interest because he had been away from the restaurant for around 45 minutes in order to look after his own child who was unwell.
He told police he had changed the child’s bed linen after she was sick, but staff at the Ocean Club were said to have denied any change of sheets was requested. The McCanns and their friends have always denied any involvement in Madeleine’s disappearance - and insist she was abducted.
The Portuguese police believe Kate McCann accidentally killed her daughter and then disposed of her body with the help of her husband. But a forensics report from Portugal’s top pathology lab has concluded there was no evidence to suggest Madeleine had died in the apartment on the night she went missing.

They arrived at 2pm - through the back door, through the Mercury garage, past the staring faces of the delivery drivers and ushered through the reception and straight into the boardroom.

It's day 153 since Madeleine McCann went missing. In that time, our newspapers and TV news bulletins have turned Kate and Gerry McCann into the best-known faces in Europe. Madeleine, meanwhile, has still not been found.

Yesterday, on the day the final photographer decamped from outside their house in Rothley, the McCanns left their home to do something they've wanted to do for a long time.

They came to the Mercury to say thank you. To their family, friends and neighbours. To their work colleagues. To the churchgoers who have prayed for Madeleine every night.

And to the Leicester Mercury readers who bought more than 50,000 green and yellow Madeleine bands, raising £57,000 for their fund.

There could be no questions about the investigation or the legal side of their case, said their spokesman, former BBC correspondent Clarence Mitchell.

But Kate and Gerry McCann spoke warmly of the help and support they had received - and how your help carried them through the lowest, loneliest periods.

Thanks for coming in and agreeing to speak to us today.

Gerry: "We just want to say thank you. That's the reason we are here. This cheque - I haven't opened it yet, but £57,000 - it's a huge amount. Both Kate and I would like to say a big, sincere thank you to everyone in Rothley and Leicestershire who has been so supportive. It means a lot to us."

How will the money be used - do you know yet?

Gerry: "We're in the process of looking into which specific areas we need to use this fund.

"We are about to start a widespread campaign so I can assure you it will be put to very good use.

"We want to increase awareness, get back to basics if you like. Target specific areas with pictures and billboards and messages. We want to refocus the coverage."

Kate: "The coverage has been on us. The coverage should be on Madeleine, no-one else."

Gerry: "But it's important for us to do this: to say a big thank you to the people who have backed us. Their support has been tremendous.

"It's more than just family, friends and neighbours. Today, I received a letter from the chaplain at Glenfield Hospital.

"Every Friday they have a vigil at the hospital. It started during the first week of Madeleine's disappearance and they are still holding them now, every Friday lunchtime.

"I've not been anywhere near Glenfield Hospital - but they're still there, still praying for us. That touches me. It keeps me going.

"Despite everything that has been written, we're still receiving many messages of support. All the letters we have received have been positive."

How much mail have you received?

Gerry: "We've been getting three big crates of mail every day. It's so much we have to collect it from the post office. We didn't think it was fair on our post lady.

"It's tailed off slightly, but we're still receiving a big box of letters every day. It's incredible."

Kate: "And the flowers, so many flowers. People have been so kind - it has made coming home a lot easier."

What has been your lowest point during all of this?

Kate: "I don't think there has been one, particular low moment. Obviously, nothing can compare with the night Madeleine went missing.

"A lot has happened since then. Sometimes, the most trivial of things can bring you crashing down."

Gerry: "I think when we were made suspects in our own daughter's disappearance; when the inference was that Madeleine was dead and that, somehow, we were involved... But, no, it can't get worse than that first night."

Kate: "Nothing has been worse than that."

Gerry: "Everything that has happened, everything we do and feel, it is all put into perspective by how we felt on that first night."

How do you keep going?

Kate: "Something carries you through. We have Sean and Amelie of course. We are there for them.

"And we still have hope. The messages of support; friends and family rallying round. You just can't overestimate what those messages of support have meant for us. They have kept us going on low days, kept us strong during the worst times.

"I've had days when if I wasn't crying about Madeleine, I was crying from the letters and messages people have sent to us. It has helped so much."

How are Sean and Amelie?

Kate: "It didn't take them long to settle back. It's familiar for them at home, they have their toys, they know where things are. They're back in nursery, they play so well together. They miss their big sister."

Do they ask about Madeleine?

Gerry: "They do."

What do you tell them?

Kate: "We tell them that she is missing and that everyone is looking for her. And that's the truth."

Gerry: "They don't dwell on it. They miss her - but they are not tormented by it. Time means nothing to them at their age. They have no comprehension of when things have happened. They're happy with themselves."

Going back to the night Madeleine disappeared, how and when did you decide that you needed to involve the media?

Gerry: "We didn't. On that Friday night, we came out of the police station and there were 150 reporters there.

"We had a quick decision to make. What do we do here? Do we ask the media for help or do we hide?"

Were you receiving professional advice at that time?

Gerry: "We had the media liaison officer from the Mark Warner resort. He helped us a lot."

How did you feel about the publicity which quickly surrounded you?

Kate: "The publicity was secondary, it really was. At first, I don't think it touched us.

There can't be many people left in Leicestershire - or anywhere else for that matter - who don't know who you are. How does that feel for you?

Gerry: "It's weird, very strange. We have had to rely on our friends and family. Our neighbours have been so good.

"They've been incredibly understanding. They have been there for us, in very testing times. There has been a huge media presence in Rothley."

Gerry says that yesterday, Wednesday, was the first day that they could look out of their windows and not be greeted by a crowd of photographers.

The last photographer left on Tuesday night. He says he'd prefer not to answer questions about the media.

What are you doing now? What do you plan to do?

Gerry: "We want to get back to basics. Timing is the issue. We are looking now at what is the most effective thing we can do in our search for Madeleine.

"The legal side has taken priority. We want to change that and refocus the attention on to finding Madeleine."

When were you aware of the green and yellow Madeleine bands?

Gerry: "It must have been quite early on. When did they start? I don't know."

Kate: "Time passed by so surreally. It was the first few hours, then eight hours, then 24 hours, 48 hours, then 72 hours... I don't remember. Each day felt like a week."

What can you say about the legal side? It's been widely reported that Portuguese Inspector Goncalo Amaral has been relieved of his duties...

Gerry: "We can't comment on that. We want to emphasise enough our thanks, to the people of Leicestershire who helped to raise this money and for the support we have received.

"It's just so uplifting. A few nights ago, we had a curry with some friends."

Kate: "It was just a takeaway, we weren't out having a meal."

Gerry: "And the waiters in the restaurant, the staff - they were so good.

"I went to the dump to throw some things away. Even there, people came up and said: 'I hope everything works out all right for you'

"These were just ordinary, everyday people - people I didn't know, people going about their business - taking time out to pass on their best wishes."

Kate: "We can be out in the car and people will put their thumbs up. It's a simple thing, but we take great comfort from that."

Have any of your patients been in touch?

Kate: "Yes, lots of them. That means a lot."

When do you plan to return to work?

Gerry: "I did think about going back to work in some capacity - but that all changed when we were declared arguidos (suspects). That has put things back a bit. I won't be changing careers, let's say. The hospital has been incredibly supportive."

Kate: "There are so many people to thank - the primary schools, Bishop Ellis Primary School in Thurmaston; Rothley Primary School; the local police - they have been excellent, so pleasant.

"Our local church. It's a five-minute walk from our house. They have been saying prayers continually. In fact, people from all faiths have been praying. We have had support from the Anglican church; from the Baptist church.

"They were planning to come together, I have heard - but I think that maybe this forced them to do it a bit quicker than they planned."

When do you expect life to return to any kind of normality?

Gerry: "Well, today is the first day there are no photographers outside our house."

Kate: "There is a semblance of normality returning. It's more normal than it was three weeks ago, Amelie and Sean see to that. But really how can it be normal? How can it be normal without Madeleine?"

Gerry: "None of this has been normal has it, really?"

Carlos Anjos, the director of the Judicial Police Inspectors Union today accused Mr and Mrs McCann of running a campaign to discredit Portuguese police.

“The McCanns started a campaign to discredit Portuguese police when they [the police] first proposed the idea that the girl was dead, in place of the abduction theory which suited them so well,” he said.

“When things moved on to the death theory, the McCanns’ position changed radically.”

This is the case in a nutshell and one needs only look at the timeline of the McCanns remarks to prove it.

I firmly believe that as this case continues; the McCanns are going to hang themselves based on their words and behavior alone. It is very clear to anyone that has just a tiny bit of a law enforcement background that this couple is hiding something. They are not believable; their actions are beyond suspicious; their words cowardly at times. It is a sad day for everyone to watch this couple continue to try to deflect and ignore what the media; the press and the police think of them. This case may never be proven much like JonBenet Ramsey's.
No matter, we have reels and reels of taped interviews. Phone conversations, emails and conversations in which this couple continually gives away small subtle clues of their guilt. Not to mention the DNA evidence which is still out.
When Susan Smith duped the world, and murdered her two children people were horrified. Today's latest revelation from Portugal is that lead investigators feel that they may be able to bring charges against the couple for falsely reporting a crime. This could carry up to a one year sentence. Not enough in the eyes of some.

The McCanns have issued a challenge to Portuguese police investigating Madeleine's disappearance saying: "Find the body and prove we killed her."
It is understood their lawyers have told them that without a body it will be extremely difficult for the authorities to press charges.
A close friend said: "The legitimate question to ask Portuguese police is: 'Where is the body? Where's the evidence that madeleine is dead? We have got no idea.'"
Meanwhile, it was revealed today that Portuguese prosecutors are planning to use Kate McCann's personal diary to help prove she killed Madeleine.
Sources close to the investigation say police believe that entries in the diary will bolster their case by revealing Mrs McCann's allegedly volatile state of mind in the days after Madeleine's disappearance in May.
In particular, they believe that the evidence could show to a court why an apparently devoted mother could have killed her child and engaged in what police believe is an elaborate cover-up.

In a bid to clear their names, a friend said today that the McCanns were considering commissioning independent forensic tests on the car where Madeleine's DNA has supposedly been found.
The car is currently being kept in a safe area while the family decide their course of action.
Mrs McCann and husband Gerry today left their Leicestershire home for the first time since returning from the resort of Praia da Luz.
They drove their two-year-old twins Sean and Amelie to play at a nearby park for an hour. Mrs McCann, 39, looked tired and drained.
Today's revelations follow an emergency application by Portugal's public prosecutor to take possession of an unnamed item - now understood to be Mrs McCann's diary - within 24 hours.
Although the diary, which Mrs McCann has kept updated since the four-year-old vanished on 3 May, is already in the police's hands, legal rules mean they need judicial authorisation to use it in any trial.
The judge, Pedro Miguel dos Anjos Frias, has a day to grant the request, which is thought to be highly unusual, but is expected to approve the application.

The source said: "Police want to seize Kate's diary to see if it can reveal what really happened on the night."
Separate sources are also reporting that police also want to confiscate Madeleine's toys, including her favourite Cuddle Cat, which Mrs McCann has clung on to ever since her daughter vanished.
Police will want to examine the toys for forensic evidence to see how much DNA they contain of Madeleine and whether that would be sufficient to be left in the boot of the McCanns' hire car.

The case against the McCanns detailed in the police report rests mainly on potentially damaging forensic test results which alleges Madeleine's DNA, contained in traces of bodily fluids, as well as her hair was found in the McCanns' hire car 25 days after she went missing on 3 May.
Portugal's attorney general has indicated the police investigation into Kate and Gerry McCann had not ended and indicated bail conditions could be imposed on the couple.
It's now thought it could take week for the Portuguese judge to go through the 4,000-page dossier of evidence against Kate and Gerry.
Jose Cunha de Magalhaes e Meneses, a public prosecutor based in Portimao in the Algarve, yesterday ordered the 10 lever-arch police files in the case to go before a criminal instructional judge.
A friend of the McCanns, citing a number of legal sources, said the family had been advised that the prosecutor is probably either seeking further guidance from the judge or applying for the authority to carry out more searches.

Today's demand came as the McCanns challenged Portuguese police: "Find the body and prove we killed her."
It is understood that lawyers acting for Kate and Gerry McCann have told them that without a body it will be extremely difficult for Portuguese authorities to press charges.
A close friend today said: "The legitimate question to ask Portuguese police is: 'Where is the body?' Where's the evidence that Madeleine is dead? We have got no idea."
The friend said the McCanns' new legal team, based in London, was working around the clock to "get up to speed on the case".
Legal sources say that without a body the case against the McCanns is weakened.
A 4,000-page police dossier on the case has now been handed to the judiciary. It is possible the judge could bring charges within days. But he could also order police to carry out more searches, conduct interviews or impose stricter bail conditions.
The fact police want to seize toys so long after the inquiry began will raise eyebrows and add to concern about the quality of the investigation. Cuddle Cat has been washed in recent weeks while other vital evidence may have been lost.
The McCanns' Portuguese lawyer Carlos Pinto de Abreu today hit out at Portugal's judicial system in a scathing interview with a local newspaper. "Justice in Portugal is slow and incapable of producing proof," he said.

"It is more appropriate to break down the patience of a believer and the reputation of an innocent man than to identify those responsible."
Another family friend said the growing speculation is taking its toll on the McCanns who left Praia da Luz, the resort where four-year-old Madeleine went missing, to return to their family home in Leicestershire at the weekend.

The source said: "Two days ago Gerry was telling everyone: 'I'm as strong as an ox'. Yesterday he was not quite as ebullient. They don't know where this is going. They fear they will be summoned back at some stage.
Presumably Portuguese authorities are looking at a trial. Gerry has remained consistent that they can explain everything that needs to be explained and will do so. They are innocent; they did not kill Madeleine and dispose of her body."

The McCanns fear they are losing the public relations battle which has seen them turn from being victims of a terrible child abduction to formal suspects in the police investigation.
Their campaign manager Justine McGuinness leaves her post on Saturday, having only ever been contracted until that date. The McCanns are now being advised to assemble a new media team to try to create more positive headlines.
But this will prove costly and the McCanns, said the source, may have to look at taking money out of the Madeleine Fund, which so far has raised more than £1 million from public donations. Such a move would risk a backlash that money raised to find Madeleine should be spent on PR.

10 key elements in McCann dossier

Neither the McCanns nor their legal team have been told the contents of the dossier of evidence presented to a judge.

They will only find out why police believe they are responsible for their daughter's disappearance if and when they are charged.

However the dossier is almost certain to contain 10 key elements:

1 Forensic evidence:
Last month samples were taken from the McCanns' holiday apartment and their Renault Scenic hire car and sent for analysis to the Forensic Science Service in Birmingham. After the test results reached Portugal last week, the McCanns were re-interviewed and declared formal suspects or "arguidos".

Reports alleged that the samples included large amounts of Madeleine's hair, as well as bodily fluids, recovered from the car boot.

2 Toxicology reports:
The Forensic Science Service is understood to have carried out toxicology tests on the samples to check whether Madeleine may have been drugged or poisoned.

Detectives are said to have asked the McCanns whether they sedated their daughter.

3 Interview transcripts:
The McCanns have been interviewed repeatedly by police since Madeleine went missing 132 days ago.

Last week, Kate McCann was questioned for 16 hours over two days. Detectives are reportedly unconvinced by the answers the McCanns gave to several key questions. The couple are also said to have exercised their right of silence on some questions.

4 Statements from the McCanns' friends:
The police must establish that there was an opportunity to kill Madeleine and for her parents to dispose of her body before charges can be considered. The statements of the seven friends who were with them on the night Madeleine went missing will be crucial in determining their movements.

5 Statements from other witnesses:
Dozens of other witnesses, many of them locals, have provided statements about what they saw on May 3 and how the McCanns behaved on holiday. They may include evidence from Pamela Fenn, who was in an apartment above the McCanns, and another witness who has allegedly described the way Kate McCann dealt with her children.

6 Phone tap evidence:
Police are said to have been bugging the McCanns' phones and intercepting their emails for weeks. Reports in the Portuguese press have suggested that some of their conversations may have contradicted statements they gave to police. One newspaper suggested that the phone taps had helped satisfy police that the couple believed their daughter was dead. Gerry McCann has told friends: "The police are listening to every word we say."

7 Background reports:
Portuguese police are reported to have spent considerable time investigating the McCanns' family background in a search for any evidence that they may have mistreated their children or have any hidden motive for wanting to harm them. Portuguese newspapers have reported something which the family have dismissed as an attempt to smear them.

8 Surveillance:
The McCanns are believed to have been under discreet video surveillance.

9 Videos of police 'cadaver' dogs:
Dogs trained to detect decomposing bodies are reported to have reacted to the "smell of death" in the McCanns' apartment, in their hire car and on Kate McCann's clothes. Police showed Mrs McCann videos of the dogs barking when they checked the car.

10 Timeline:
The police will have compiled a comprehensive timeline of events to explain who was where at what times.
